Terms of Service

1. Acceptance of terms

By creating an account or using Aged Oak, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the app. These terms apply to all users, including seniors, family members, and caregivers.

2. Eligibility

You must be at least 18 years old to create an account. By using Aged Oak, you represent that you meet this requirement and that any information you provide is accurate and kept up to date.

3. Description of service

Aged Oak is a wellness companion app that provides reminders, check-ins, emergency tools, and family connectivity features. We are not a medical provider, and the app does not constitute medical advice, diagnosis, treatment, or emergency dispatch services.

4. Not a medical or monitoring service

Aged Oak is not a substitute for professional medical care, a medical-alert monitoring service, or 24/7 human monitoring. Reminders and check-ins are conveniences, not guarantees. Always consult a qualified healthcare professional for medical concerns.

5. Emergency services disclaimer

The SOS feature is designed to assist, not replace, official emergency services. It depends on your device, network connectivity, and location settings, which may not always be available. Always call 911 directly in a life-threatening emergency. Aged Oak is not liable for delays or failures in emergency response.

6. Account responsibilities

You are responsible for maintaining the security of your account credentials, the accuracy of the information you provide (including emergency contacts and medical details), and all activity that occurs under your account. Notify us immediately of any unauthorized access.

7. Subscriptions, billing & cancellation

• Paid plans are billed monthly or annually and renew automatically until cancelled.
• You may cancel at any time; cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial billing periods unless required by law.
• We will give advance notice of any price change, and continued use after the change takes effect constitutes acceptance.

8. Acceptable use

You agree not to:

• Violate any law or the rights of others.
• Harass, abuse, or harm another person.
• Attempt to gain unauthorized access to our systems or other users’ accounts.
• Interfere with or disrupt the service, or resell or redistribute it without our written permission.

9. Partner & third-party services

Aged Oak integrates with third-party partners (such as Lyft, DoorDash, and health services). Your use of partner services is governed by their own terms and privacy policies. Aged Oak is not responsible for partner service quality, availability, or actions.

10. Intellectual property

Aged Oak and its content, features, and branding are owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes in accordance with these terms.

11. Disclaimer of warranties

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, Aged Oak and its affiliates will not be liable for any indirect, incidental, or consequential damages, and our total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Aged Oak harmless from claims, losses, and expenses arising from your misuse of the service or your violation of these terms.

14. Governing law & dispute resolution

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will first be addressed through good-faith informal resolution; if unresolved, it will be handled in the state or federal courts located in California, unless applicable law provides otherwise.

15. Termination

You may stop using Aged Oak and delete your account at any time. We may suspend or terminate access if you violate these terms or to protect the service or other users. Provisions that by their nature should survive termination will do so.

16. Changes to these terms

We may update these terms with at least 30 days’ notice via email or in-app notification. Continued use of Aged Oak after that period constitutes acceptance of the updated terms.
